1.2 Purpose

This Legal Notice governs access to, navigation of and use of the website mallorcaecoride.es, through which Mallorca Eco Ride SL provides information and the booking of light electric vehicle (Fiat Topolino) rental experiences and tourist routes around Palma de Mallorca. Using the site confers the status of user and implies full acceptance of this Legal Notice.

1.3 Conditions of use

The user undertakes to make appropriate and lawful use of the site and its contents. In particular, the user agrees to refrain from:

• Using the site for unlawful purposes or purposes harmful to the rights of third parties.
• Introducing or spreading viruses or systems that may damage the owner's or third parties' systems.
• Accessing or manipulating data, systems or services without authorisation.
• Reproducing, copying or transforming the contents without express authorisation.

1.4 Intellectual and industrial property

All contents of the site —texts, photographs, graphics, icons, design, software, trademarks and logos— are owned by Mallorca Eco Ride SL or by third parties who have authorised their use, and are protected by intellectual and industrial property law. «Fiat» and «Topolino» are trademarks of their respective owners; their mention is purely descriptive of the vehicle used.

1.5 Liability and links

The owner does not guarantee the uninterrupted availability of the site and is not liable for damages arising from technical failures or the presence of viruses beyond its control. The site may contain links to third parties (social networks or the payment gateway), for whose content and policies the owner assumes no responsibility.

1.6 Applicable law

This Legal Notice is governed by Spanish law. Unless consumer regulations impose another jurisdiction, the parties submit to the Courts and Tribunals of Palma de Mallorca.

2.2 Purposes, legal basis and retention

We do not share your data except by legal obligation. We work with providers acting as processors (art. 28 GDPR):

• Stripe Payments Europe, Ltd. — payment processing.
• Hostinger — web hosting and domain (includes our own booking form).

The booking is managed through our own form hosted on the site; we do not use third-party booking platforms. No analytics or marketing tools processing personal data are used; should any be added in the future, this policy and the cookie policy will be updated.

2.4 Your rights

You may exercise your rights of access, rectification, erasure, objection, restriction and portability, and withdraw your consent, by writing to reservas@mallorcaecoride.es. You may also lodge a complaint with the Spanish Data Protection Agency (aepd.es). Some providers (e.g. Stripe) may process data outside the EEA, under the European Commission's Standard Contractual Clauses.

This site only uses technical cookies necessary for its operation and those of the payment gateway (Stripe). No analytics or marketing cookies are used, so a consent banner is not required.

4.1 The rental vehicle

The vehicle offered is the electric Fiat Topolino, type-approved as an L6e light quadricycle, with the following limitations:

• Top speed limited to 45 km/h.
• Not allowed on motorways or dual carriageways; only urban roads and conventional roads.
• Maximum capacity: 2 people.
• 5.4 kWh battery, range approx. 75 km (WMTC cycle), variable depending on driving, terrain and temperature.
• Towing, being towed and roof racks are not permitted. No airbags or air conditioning.

4.2 Driver requirements

• Minimum age of 23 years.
• Valid driving licence (category B or higher) held for at least 2 years.
• Present a valid licence and original ID card or passport at pick-up.
• Non-EU licences require an International Driving Permit.
• Only the person named as authorised driver in the contract may drive; do not drive under the influence of alcohol or drugs.

4.3 Price and VAT

All prices shown are expressed in euros and include VAT (21%): €105 for the 3-hour tour (promotional price, standard rate €180) and €180 for the full-day rental. No hidden charges or management fees. The price is per vehicle (up to 2 people) and may vary by season, availability and current offers; the price shown at the time of booking applies.

4.4 Deposit

• Deposit of €150 per vehicle, paid by card at pick-up, prior to handover.
• It is not part of the rental price and is returned to the same payment method within a maximum of 7 business days, after checking the condition of the vehicle.
• It may be withheld in full or in part to cover damage, fines, late charges or recovery costs, with an itemised breakdown provided.

4.5 Insurance and excess

The vehicles carry the compulsory third-party liability insurance. The damage excess is €300 per incident.

4.6 Pick-up, fines, battery and delays

• Pick-up and return: exact point and time are communicated in the booking confirmation.
• Fines: at the customer's expense, plus a €30 handling charge per penalty file.
• Battery: delivered at 100%; may be returned at any level. If it runs out before returning and requires recovery, minimum costs of €60.
• Delays: 15 min grace period; after that, €15 per each 30-minute fraction. More than 2 h without notice may be reported as misappropriation.

4.7 Payment

Payments are processed by Stripe Payments Europe, Ltd., an independent controller of the payment data. Mallorca Eco Ride never stores the full card details.

4.8 Cancellations and right of withdrawal

Under art. 103.l) TRLGDCU, the 14-day right of withdrawal does not apply to vehicle rentals and leisure activities with a specific date or period of performance. Once the booking is confirmed with a specific date, the Renter may not withdraw. Notwithstanding this, voluntary cancellation is recognised on the following terms:

The Lessor will refund the amount in full if the cancellation is due to a cause attributable to it. Cancellations must be notified in writing to reservas@mallorcaecoride.es; the refund is credited to the same payment method within 3-5 business days. In the event of adverse weather or force majeure, a free date change or a full refund is offered.

4.9 Complaints and legislation

For any enquiry or complaint: reservas@mallorcaecoride.es. As a consumer you may use the European Commission's Online Dispute Resolution platform (ec.europa.eu/consumers/odr). These Terms are governed by Spanish law; in relations with consumers the jurisdiction of their domicile applies, and in all other cases the Courts and Tribunals of Palma de Mallorca.
